Adventure Health Magazine LLC Terms of Use

Welcome to Adventure Health Magazine LLC’s (“AHM,” “we,” “us,” or “our”) website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Site.  

1. Use of the Site 1.1. You may use the Site for personal, non-commercial purposes only. You may not use the Site for any unlawful or prohibited purpose.

1.2. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Site.  

2. User Content 2.1. The Site may allow you to submit, upload, post, or otherwise make available content, such as comments, reviews, or photos (“User Content”). You retain ownership of any intellectual property rights that you hold in that User Content. However, by submitting User Content to the Site, you grant AHM a royalty-free, perpetual, irrevocable, non-exclusive, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content throughout the world in any media.  

2.2. You are solely responsible for your User Content and the consequences of posting or publishing it. By submitting User Content to the Site, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize AHM to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content and to enable inclusion and use of the User Content in the manner contemplated by the Site and these Terms.  

3. Intellectual Property 3.1. The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by AHM, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.  

4. Disclaimers 4.1. The Site is provided on an “as is” and “as available” basis. AHM makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site. You expressly agree that your use of the Site is at your sole risk.  

5. Limitation of Liability 5.1. In no event shall AHM, its directors, employees, or agents be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of the Site or with the delay or inability to use the Site, or for any information, software, products, and services obtained through the Site, or otherwise arising out of the use of the Site, whether based on contract, tort, strict liability, or otherwise, even if AHM has been advised of the possibility of such damages.  

6. Changes to these Terms 6.1. AHM reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, AHM will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at AHM’s sole discretion.  

7. Governing Law and Jurisdiction 7.1. These Terms shall be governed and construed in accordance with the laws of [Your State], without regard to its conflict of law provisions.
